    A Greek scholar warns that a potential conflict in the South China Sea will benefit no one. George Tzogopoulos, a lecturer of the European Institute and the Democritus University of Thrace in Greece, on Wednesday said what is challenging now is to preserve peace in the South China Sea. The Chinese government on Wednesday issued a white paper to expound on its position, which calls for settling relevant disputes between China and the Philippines in the South China Sea through negotiation. China also says the Arbitral Tribunal established at the Philippines' unilateral request has no jurisdiction over relevant submissions, and awards rendered by it are null and void and have no binding force.

The so-called South China Sea arbitration unilaterally initiated by the Philippines has been manipulated by the United States and its allies since the very beginning, an expert said on Friday in Hong Kong during an international law colloquium on maritime disputes settlement. Wu Shicun, president of China's National Institute for South China Sea Studies, told China Central Television (CCTV) while attending the colloquium that the entire design and arrangement of the arbitration was manipulated. "I believe that behind the arbitration, it is the manipulation of some Western countries, which started from the design of the arbitration process and the appointment of arbitrators. The arbitrators of the arbitral tribunal were selected in January 2013 by the Japanese presiding judge of the International Tribunal for the Law of the Sea. Among the five arbitrators, four were hand-picked by himself. As is known to all, Japan has disputes with China over territorial areas and maritime demarcation. And the judge was once Japanese ambassador to the United States as well as a legal advisor assisting Abe to amend the peace constitution. I don't think such a person, with such a political background, can be objective and fair when appointing arbitrator.... The arbitral tribunal was designed and composed deliberately even from the selection of arbitrators. During the three-year period, it was the United States that manipulated behind the screen. The lawyer team of the Philippines is made up of famous U.S. lawyers completely," said Wu. Wu said the United States is actually the manipulator of the arbitration behind the screen. Declaring to be neutral while in fact supporting countries that have disputes with China, the United States is trying to contain China further, according to Wu. "So the current situation is a typical illustration of an ancient Chinese saying 'the eunuch, instead of the emperor, is anxious about the case'. The United States is quite anxious about the case now. So it can be seen that the arbitration has been utilized by the United States and its largest ally in the region – Japan – to achieve their political purposes. They are trying to cow China into submission regarding the South China Sea issue and put China in a passive position. I think it is purely a political manipulation. So just like Foreign Minister Wang Yi has said, this is a political farce. The word matches the reality," said Wu. The two-day colloquium, attended by law experts and scholars as well as politicians, will touch upon topics including the scope of territorial sovereignty and ownership of maritime rights and interests. Chinese State Councilor Yang Jiechi dismissed the so-called South China Sea arbitration award as "illegal and invalid" and pointed out that China's sovereignty and marine rights over the South China Sea brooks no denial. Yang made the remarks in an interview with Chinese media on Thursday. "Recently, the Arbitral Tribunal for the South China Sea arbitration has issued its so-called award. This award is illegal and invalid in every sense. The Chinese government has released relevant statements and a White Paper stating its solemn position of firmly opposing the arbitration and not accepting or recognizing the award. This position of the central government has the strong support and endorsement from people of various social sectors in China. They have expressed their unequivocal attitude of opposing the illegal arbitration and safeguarding sovereign rights and interests by contributing articles and articulating views through the press, TV and SMS as well as online platforms like WeChat and Weibo," said Yang. Yang stressed that the South China Sea arbitration has been a political farce all along, staged under the cover of law and driven by a hidden agenda. He said certain countries outside the region have attempted to deny China's sovereign rights and interests in the South China Sea through the arbitration. They have even brought other countries into the scheme to isolate and discredit China in the international community with a view to holding back China's peaceful development, added Yang. Yang said such attempts are futile, to say the least, and in so doing, these countries are only lifting a stone to drop it on their own feet. Yang pointed out that the arbitration runs counter to the spirit of international rule of law, puts regional peace and stability in jeopardy, and undermines the interests of the international community. Most countries in the world see this clearly, said Yang. He said over 70 countries and international and regional organizations have made statements showing their understanding of and support for China's position. This speaks volumes about the attitude of the international community toward the political farce, proving the futility of certain countries' scheme to hem in and smear China, said Yang. "Sovereignty is a bottom line for China. Big as China is, we cannot afford to give away a single inch of territory that our ancestors have left to us. China's territorial sovereignty and maritime rights and interests in the South China Sea have been formed over the course of over two thousand years. They are fully backed by historical and legal evidence. Under no circumstances can they ever be negated by a so-called award that is full of nonsense. The award can neither change historical facts nor deny China's claims of rights and interests in the South China Sea. Still less can it waver our resolve and determination to safeguard territorial sovereignty and maritime rights and interests. China's position of not accepting or recognizing the award will not change. At the same time, China will stay committed to following a path of peaceful development, to resolving the disputes in the South China Sea through negotiation and consultation, to developing friendly relations and win-win cooperation with its neighbors, and to working with others to maintain peace and stability in the South China Sea," said Yang. This seminar analysed the situations in which issue estoppel may (or may not) be invoked in connection with applications for the refusal of recognition and enforcement of arbitration awards under the New York Convention. This is an issue which has become topical following the decisions in England in Diag Human SE v The Czech Republic [2014] EWHC 1639 (Comm) (Eder J) and in Hong Kong in Astro Nusantara International BV HCCT No.45 of 2010 (17 February 2015) (Chow J). In Diag, it was held that a decision of the Austrian Supreme Court that a Czech award was “not binding” created an issue estoppel in the context of enforcement proceedings in England. In Astro Nusantara, it was held that a party was estopped from belatedly resisting the enforcement of an award in Hong Kong, since that party had deliberately decided not to contest recognition and enforcement here at an earlier stage. This was despite the fact that, as against the relevant party, the award had been set aside by the Singapore Court of Appeal. Both decisions have been criticised by academic commentators as going against the principles that underpin the Model Law and New York Convention. Sir Bernard Eder was appointed Justice of the High Court of England and Wales (Queen's Bench Division) in 2011. There he sat in the Commercial Court and, from time to time, in the QBD, the Administrative Court and the Court of Appeal (Criminal Division), as well as on circuit in the Crown Courts. He retired from the English Judiciary on 2 April 2015. He graduated with a double-first in law from Cambridge in 1974 and was called to the Inner Temple in 1975. He practised from Essex Court Chambers for nearly 35 years, specialising in commercial litigation and international arbitration. He took silk in 1991. He acted as counsel in numerous foreign jurisdictions and sat as arbitrator in ICC, LCIA and LMAA arbitrations, as well as on an ad hoc basis. He was Visiting Professor at UCL (where he taught Shipping Law) between 1999 and 2003. He is currently Senior Editor of Scrutton on Charterparties and Bills of Lading.
