    A Greek scholar warns that a potential conflict in the South China Sea will benefit no one. George Tzogopoulos, a lecturer of the European Institute and the Democritus University of Thrace in Greece, on Wednesday said what is challenging now is to preserve peace in the South China Sea. The Chinese government on Wednesday issued a white paper to expound on its position, which calls for settling relevant disputes between China and the Philippines in the South China Sea through negotiation. China also says the Arbitral Tribunal established at the Philippines' unilateral request has no jurisdiction over relevant submissions, and awards rendered by it are null and void and have no binding force.

Among the five arbitrators, four were hand-picked by himself. As is known to all, Japan has disputes with China over territorial areas and maritime demarcation. And the judge was once Japanese ambassador to the United States as well as a legal advisor assisting Abe to amend the peace constitution. I don't think such a person, with such a political background, can be objective and fair when appointing arbitrator.... The arbitral tribunal was designed and composed deliberately even from the selection of arbitrators. During the three-year period, it was the United States that manipulated behind the screen. The lawyer team of the Philippines is made up of famous U.S. lawyers completely," said Wu. Wu said the United States is actually the manipulator of the arbitration behind the screen. Declaring to be neutral while in fact supporting countries that have disputes with China, the United States is trying to contain China further, according to Wu. "So the current situation is a typical illustration of an ancient Chinese saying 'the eunuch, instead of the emperor, is anxious about the case'. The United States is quite anxious about the case now. So it can be seen that the arbitration has been utilized by the United States and its largest ally in the region – Japan – to achieve their political purposes. They are trying to cow China into submission regarding the South China Sea issue and put China in a passive position. I think it is purely a political manipulation. So just like Foreign Minister Wang Yi has said, this is a political farce. The word matches the reality," said Wu. The two-day colloquium, attended by law experts and scholars as well as politicians, will touch upon topics including the scope of territorial sovereignty and ownership of maritime rights and interests. This seminar analysed the situations in which issue estoppel may (or may not) be invoked in connection with applications for the refusal of recognition and enforcement of arbitration awards under the New York Convention. This is an issue which has become topical following the decisions in England in Diag Human SE v The Czech Republic [2014] EWHC 1639 (Comm) (Eder J) and in Hong Kong in Astro Nusantara International BV HCCT No.45 of 2010 (17 February 2015) (Chow J). In Diag, it was held that a decision of the Austrian Supreme Court that a Czech award was “not binding” created an issue estoppel in the context of enforcement proceedings in England. In Astro Nusantara, it was held that a party was estopped from belatedly resisting the enforcement of an award in Hong Kong, since that party had deliberately decided not to contest recognition and enforcement here at an earlier stage. This was despite the fact that, as against the relevant party, the award had been set aside by the Singapore Court of Appeal. Both decisions have been criticised by academic commentators as going against the principles that underpin the Model Law and New York Convention. Sir Bernard Eder was appointed Justice of the High Court of England and Wales (Queen's Bench Division) in 2011. There he sat in the Commercial Court and, from time to time, in the QBD, the Administrative Court and the Court of Appeal (Criminal Division), as well as on circuit in the Crown Courts. He retired from the English Judiciary on 2 April 2015. He graduated with a double-first in law from Cambridge in 1974 and was called to the Inner Temple in 1975. He practised from Essex Court Chambers for nearly 35 years, specialising in commercial litigation and international arbitration. He took silk in 1991. He acted as counsel in numerous foreign jurisdictions and sat as arbitrator in ICC, LCIA and LMAA arbitrations, as well as on an ad hoc basis. He was Visiting Professor at UCL (where he taught Shipping Law) between 1999 and 2003. He is currently Senior Editor of Scrutton on Charterparties and Bills of Lading.

Arbitrators, as well as international lawyers would do well to acquire this book, published recently by Informa Law from Routledge and now in a second revised edition. Certainly as a dispute resolution jurisdiction, Singapore has acquired what is widely regarded as a worthy and formidable reputation for the efficient conduct of this type of legal service. Since 1986, Singapore has been a signatory to the New York Convention on the Recognition and Enforcement of Foreign Arbitration Awards 1958. The writers also stress that Singapore’s legal system is ‘fully equipped to allow it to take its place as a leading forum for hosting international arbitrations.’ Since the first edition was published in 2009, the law of arbitration in Singapore has undergone a number of changes which of course are incorporated in this new edition. For example, important amendments have been made to the International Arbitration Act and the Arbitration Act, the courts have handed down approximately 100 decisions on arbitration matters and there is a new set of SIAC Rules (Singapore International Arbitration Centre). There are thirty-seven of these listed in Chapter 6. New material in this edition also includes the State Immunity Act and the Contracts (Rights of Third Parties) Act. It is also mentioned that Singapore is a signatory to the UNCITRAL Model Law, but has also adopted what is referred to as its own distinctive approach to a number of issues, virtually all of which emerge in this book, including a number of interesting comparisons between arbitration in London and arbitration in Singapore. Chinese State Councilor Yang Jiechi said that the South China Sea arbitration will not shake China's resolve to pursue the path of peaceful development on Thursday. Yang made the remarks in an interview with state media on the so-called award of the Arbitral Tribunal for the South China Sea arbitration. "A basic requirement of international rule of law is that actions must be taken in strict accordance with the law. The Tribunal can in no way represent international law, still less equity and justice in the world," said Yang. Yang said history brooks no distortion and law no abuse. He said China's sovereignty, rights and relevant claims in the South China Sea are gradually formed and developed by the practice of the Chinese people throughout millennia and have been upheld by successive Chinese governments. As early as in 1948, the Chinese government marked the dotted line in the South China Sea on its officially published map, which affirmed China's sovereignty over the South China Sea Islands and maritime rights and interests in their adjacent waters, said Yang. This is a historical fact beyond any doubt, added Yang. Yang said China, as a state party to UNCLOS, is fully entitled to its rights under UNCLOS. China's claims of rights and interests in the South China Sea long predate the signing of UNCLOS and shall by no means be denied by UNCLOS let alone by an unwarranted and flawed award, added Yang. China's sovereignty and maritime rights and interests in the South China Sea are protected by both international law and UNCLOS, stressed Yang. "The South China Sea, important to the Chinese people since ancient times, is our heritage to which our forefathers devoted their wisdom and even lives. The Chinese government remains unwavering in its resolve to safeguard China's territorial sovereignty and maritime rights and interests in the South China Sea. The Chinese people do not covet other countries' interests or envy their development. At the same time, we will never give up our legitimate interests. No country should expect us to trade our core interests away or swallow the bitter consequences of our sovereignty, security and development interests being undermined. The Chinese government and people will remain united and act resolutely to safeguard every inch of our land and every swath of our waters," said Yang. Yang said the attempt to mount an all-out smear campaign against China by distorting this basic fact has once again exposed the nature of this arbitration, that is, a farce in which certain countries use international law as a cover to pursue their own hidden agenda. He stressed that China's position on the arbitration fully complies with international law. He stated that the South China Sea arbitration will not "in the slightest way" shake China's resolve to pursue the path of peaceful development China has all along been an active player in building up and enhancing the regional and international order.
